Door to door sales laws Louisiana for the cancel window and the parish permit

Knockdesk is field sales software for teams that sell in person. On a Louisiana territory, door to door sales laws louisiana are the cancel right in R.S. 9:3538, the oral-communication rule in R.S. 15:1303, and the parish permit. A solicitor permit louisiana is that parish or city card. Section 3538 points the definition of a home solicitation sale to R.S. 9:2711.1 and R.S. 9:3516(20). This page does not restate a price floor from those definition sections. This page is general information, not legal advice. The table is the statute map, not a ruling.

The section defines a home solicitation sale by reference to R.S. 9:2711.1 and R.S. 9:3516(20).https://www.legis.la.gov/legis/Law.aspx?d=107627
In-person recording consentR.S. 15:1302(17) defines an oral communication as speech uttered by a person who expects it is not subject to interception, under circumstances that justify that expectation. R.S. 15:1303(C)(4) says it is not unlawful for a person not acting under color of law to intercept a wire, electronic, or oral communication when that person is a party, or when one party has given prior consent, unless the purpose is a criminal or tortious act or any other injurious act. Oral communication is in-person speech. The consent rule is not telephone-only.https://www.legis.la.gov/legis/Law.aspx?d=78938
State solicitor or peddler licenseR.S. 9:3538 sets the cancel right. It does not issue a solicitor card for the five cities in the next table.https://www.legis.la.gov/legis/Law.aspx?d=107627

Five Louisiana desks, five different cards

A solicitor permit louisiana is not one state badge. New Orleans uses a Department of Finance permit. Baton Rouge publishes a house-to-house peddler file. Shreveport and Lafayette require a permit before the uninvited sale. Lake Charles requires written registration for the solicitation its notice describes. In those five cities, door to door solicitation laws louisiana are that split. The manager still cannot see the turf if the card stays in a folder.

New OrleansSection 110-222 requires a Department of Finance permit to canvass or solicit house to house for commercial purposes. Each permit is $50 for each solicitor or canvasser, and each agent using it needs a $5 identification card. The permit is not valid in the Vieux Carre, the Convention Center zone, the Riverfront Zone, or the Lower Riverfront Zone. Commercial means proposing a commercial transaction. A purely voluntary religious, political, or charitable donation is exempt unless an item is offered for sale or at a fixed price.https://library.municode.com/la/new_orleans/codes/code_of_ordinances?nodeId=PTIICO_CH110PESOITVE_ARTIIISO_S110-222PEDIADBRLEET
Baton RougeThe city peddler page lists a house-to-house peddler ordinance and the steps to obtain a peddler permit and an ID badge. The ordinance file itself is a separate document.https://www.brla.gov/661/Peddler-Permit-Information
ShreveportSection 42-277, as Ordinance No. 92 of 2017 reenacts it, requires a permit for the company and for the individual before an uninvited visit to a private residence to solicit orders or to peddle goods or services. After the materials and the $100 payment, the permit issues within 10 business days or the applicant is told why it will not. Hours are 8:00 a.m. to 7:00 p.m. when daylight saving time is not in effect, and 8:00 a.m. to 8:00 p.m. when it is. A visible identification badge is required.https://www.shreveportla.gov/AgendaCenter/ViewFile/Item/13933?fileID=15112
LafayetteSection 70-61 requires a permit from the Lafayette City-Parish Consolidated Government before a peddler or door-to-door vendor offers goods, merchandise, or services for sale or rental, or takes orders. Section 70-62 sets the permit fee at $125. Section 70-3 lets a licensed door-to-door vendor go onto private property without a specific invitation only from 9:00 a.m. to 4:00 p.m., Monday through Friday. Saturday, Sunday, and other hours need that invitation.https://library.municode.com/la/lafayette_city-parish_consolidated_government/codes/code_of_ordinances?nodeId=PTIICOOR_CH70PEDO-DVEMOFOES_ARTIVMOFOES_DIV3MOFOESOP_S70-119ADMO
Lake CharlesThe city notice quotes section 12-38: a person who wants to solicit funds, contributions, or payments, or to distribute literature that solicits contributions or payments, by going uninvited to a private residence, must first get written registration from the director of finance. The notice says a registration is valid for no more than 90 days, hours are 9:00 a.m. to 6:00 p.m., and the registrant wears a photo identification issued by the city. Acting without that registration is a misdemeanor.https://www.cityoflakecharles.com/egov/apps/document/center.egov?id=3931&view=item

The stop

A posted sign and the sales tax certificate

Shreveport and Lake Charles put the refusal on the residence. The other city pages in the table do not publish a no-knock address list. A dealer who sells tangible personal property still needs the state sales tax certificate.

Known no-knock registriesShreveport section 42-277 says solicitation ceases on a no solicitation sign at the residence. The Lake Charles notice says registrants shall not go uninvited where a No Trespassing or No Solicitors sign is posted. The New Orleans permit section, the Baton Rouge peddler page, and the Lafayette sections opened here do not publish a no-knock address list.https://library.municode.com/la/shreveport/codes/code_of_ordinances?nodeId=PTIICOOR_CH42LIPEBURE_ARTIXPESOOTPUVE_DIV1GE
Sales tax for in-home salesThe Department of Revenue says a seller who qualifies as a dealer under R.S. 47:301(4) must apply for a sales tax certificate. That includes a seller of tangible personal property in the state and a seller who operates through salesmen or agents. The state general sales tax is levied on the retail sale of tangible personal property.https://revenue.louisiana.gov/businesses/general-sales-and-use-taxes/general-sales-use-tax/

The knock

The parish permit does not log Not Home

New Orleans can ask for the finance permit. Lafayette can ask for the $125 permit. The visit still has to land on the address. Knockdesk keeps the territory and the turf. Log visit includes Not Home. Do Not Contact stays off the knock list and does not count toward coverage. Recording is opt-in. The consent step comes before a file starts, and skip still logs the outcome. A score does not replace the outcome. Onboarding does not block knocks. Import and export only.
