Door-to-door sales laws in Alabama

Alabama splits the cancel right from the city permit

Knockdesk is field sales software for crews that sell in person. Alabama door-to-door sales law comes down to three things: a right to cancel a credit sale, a one-party rule for a private conversation, and a permit from the city. There is no single statewide solicitor card. This page is general information, not legal advice.

Home solicitation or cooling-offSection 5-19-12 lets a buyer cancel a home solicitation sale until midnight of the third business day. The Mini-Code defines that sale as a consumer credit sale made away from the seller's place of business, so a cash sale is outside this section. A cancellation notice that meets the federal cooling-off rule can satisfy the state notice. A cash sale at the home can still fall under the federal cooling-off rule.https://law.justia.com/codes/alabama/title-5/chapter-19/section-5-19-12/
In-person recording consentSection 13A-11-30 defines eavesdropping as overhearing, recording, amplifying, or transmitting any part of a private communication without the consent of at least one person in that conversation. Section 13A-11-31 makes it a crime to use a device to eavesdrop, whether or not the person is present. That includes a private conversation at the door. It is not limited to phone calls.https://law.justia.com/codes/alabama/title-13a/chapter-11/article-2/section-13a-11-31/
Employee monitoring noticeAlabama does not publish a general law that requires notice before an employer monitors employees electronically.https://law.justia.com/codes/alabama/title-13a/chapter-11/article-2/section-13a-11-30/
State solicitor or peddler licenseSection 40-12-174 is a privilege license tax on transient vendors and peddlers. It covers a person going from house to house and a person soliciting orders with a sample. It does not create one state office that issues solicitor permits. Cities still issue their own.https://law.justia.com/codes/alabama/title-40/chapter-12/article-2/section-40-12-174/

Five city permits

Where Alabama issues the solicitor permit

A manager looking up door-to-door solicitation laws in Alabama is usually asking which city takes the application. The state privilege license tax does not replace the permits in Huntsville, Mobile, or Tuscaloosa.

MontgomeryMontgomery does not publish a separate solicitor permit. Chapter 20 limits the hours for knocking at homes and bars a knock where the house posts a no-solicitation sign. It points the crew to the city's business and transient licenses. The License and Revenue Division handles those licenses at 25 Washington Avenue, 3rd Floor. Signs and sales tax

No shared address list, and no special tax rate

In Montgomery, a posted sign is a rule for that house. The crew can read it from the porch. The city does not hand out a shared list of those addresses. The state sales-tax page lists a general rate. It does not list a separate rate for a sale made at the door.

No-knock registryBirmingham, Huntsville, Montgomery, Mobile, and Tuscaloosa do not publish a list of addresses where knocking is banned. In Montgomery, it is unlawful to solicit at a home that posts a no-solicitation, no-peddling, or no-trespass sign.https://library.municode.com/al/montgomery/codes/code_of_ordinances?nodeId=COOR_CH20PESO
Sales tax for an in-home saleThe Department of Revenue lists a general state sales and use tax of 4 percent. It does not publish a special rate for a sale made in the home.https://www.revenue.alabama.gov/sales-use/state-sales-use-tax-rates/

After the permit

The permit does not log who was home

Tuscaloosa's revenue department can issue the solicitor permit, and the police department can issue the photo ID. Neither office records whether anyone came to the door.

In Knockdesk, the manager logs that visit on the address, inside the territory and the turf. The rep uses Start Knock or Log visit, and Not Home is one of the outcomes. An address marked Do Not Contact stays off the knock list and does not count toward coverage.

Recording stays off until the rep turns it on. Consent is required before a recording file starts. If the rep skips the recording, the visit outcome is still logged, and a score does not take the place of that outcome. Onboarding does not stop the crew from knocking. Leave-behinds and door hangers are not part of Knockdesk.

FAQ

Frequently asked questions

Does Alabama have its own home solicitation cancel right?

Yes. Section 5-19-12 gives the buyer until midnight of the third business day to cancel a home solicitation sale. The Mini-Code defines that sale as a consumer credit sale. A cash sale at the home can still fall under the federal cooling-off rule.

Can the crew record a conversation at the door in Alabama?

Criminal eavesdropping covers recording a private conversation without the consent of at least one person in it. The rule applies whether or not the person recording is present. In Knockdesk, consent comes before a recording starts. If the rep skips recording, the visit outcome is still logged.

Who issues the solicitor permit an Alabama crew actually carries?

Section 40-12-174 is a privilege license tax, not a single state permit. Huntsville issues a solicitor's license. Mobile publishes a peddler's license. Tuscaloosa requires a solicitor permit from the revenue department. Birmingham and Montgomery do not publish a separate solicitor permit.

What should the crew watch for on an Alabama route?

Watch the city permit office, a posted sign in Montgomery, and whether the visit was logged. An address marked Do Not Contact stays off the knock list and does not count toward coverage.

Is this legal advice?

No. This page is general information, not legal advice. The manager still confirms the city permit and the cancel notice with the people who own that compliance.

How much does Knockdesk cost?

The Full desk plan is listed on the pricing page. A free trial is not open.
