# Two party consent states for the talk at the door

Two party consent states are the all-party states the Reporter's Recording Guide names for recording. Knockdesk is field sales software for teams that sell in person. In-person rules can differ from phone rules. This page is general information, not legal advice. The table is in-person consent from that guide and from 18 U.S.C. 2511, not a phone-only blog list.

## All party consent states and one party consent states

All party consent states are the same group people mean when they say two party consent states. The Reporter's Recording Guide says those laws are often called two-party, but they require every party's consent. One party consent states are the states that follow the federal floor: a party to the talk may record it. The guide still sends the reader to the state chapter, because a state can split in-person and phone.

**Two party consent states.** Casual name for all-party states. The introduction lists California, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan with a third-party caveat, Montana, New Hampshire, Pennsylvania, and Washington.

**All party consent states.** The technical name. Every party to the conversation must consent before the recording.

**One party consent states.** Federal law in 18 U.S.C. 2511 is this floor. Vermont has no state recording law, so that floor is the rule there.

## The door is not the same as a call

A phone chart will misread the porch. The introduction says Missouri and Oregon require all parties in person and one party on the phone, then the Oregon chapter updates the public in-person piece. Connecticut and Nevada flip it: one party in person, all parties on the phone. Can you record a conversation at someone's door is an in-person question. Open the in-person row, not a call list.

| State | In person | Phone |
| --- | --- | --- |
| Missouri | All parties for a private talk, per the Missouri chapter | One party |
| Oregon | See the Oregon chapter. The public in-person provision was struck | One party |
| Connecticut | At least one party | All parties for civil liability |
| Nevada | One party for a private talk | All parties |

## Is it legal to record sales conversations

Is it legal to record sales conversations starts with the federal floor, then the state chapter for that territory. The introduction says a person's home has special significance and in-person talks there have the greatest expectation of privacy. Implied consent can attach when the device is in plain view or the parties are warned and keep talking. Knockdesk does not decide that. Enable Recording asks the rep to confirm Verbal Consent, Written Consent, or Will Record Consent before Start Recording. Knockdesk does not ask the other party.

**The home.** The guide treats the home as the place with the greatest expectation of privacy. A confidential talk there is not a sidewalk talk.

**The prompt.** The rep confirms how consent was obtained, then starts or skips the file. Skip Recording still logs the visit.

**The outcome.** The file does not overwrite the outcome the rep logged. Coaching reads the talk later.

## A consent chart does not keep the file

The state table answers whose consent the guide names. It does not store the talk. When the chapter sits in a browser tab and the visit sits in a chat, the manager cannot replay the door. Knockdesk keeps consent, the file, and the outcome on one Full desk. 418 Oak Ave and 90 Pine Ct on this page are a sample, not a customer's week. Full desk is on the pricing page. A free trial is not open.

These are the pages the table cites. A later chapter can change a row. Knockdesk is not counsel.

## FAQ

### What are two party consent states?

The Reporter's Recording Guide calls them all-party states and lists California, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan with a third-party caveat, Montana, New Hampshire, Pennsylvania, and Washington. The name two-party is casual. The rule is all parties. This page is general information, not legal advice.

### What are all party consent states?

States that require every party's consent before a recording. The introduction uses that term for the same group people call two party consent states.

### What are one party consent states?

States that follow the federal floor in 18 U.S.C. 2511: a party to the talk may record it, unless the intercept is for a crime or tort. Vermont has no state recording law, so that floor applies there.

### Can you record a conversation at someone's door?

That is an in-person question, and the guide says a home has the greatest expectation of privacy. All-party states need every party's consent for a confidential talk. Some states split in-person and phone. Knockdesk asks the rep to confirm consent. It does not ask the other party.

### Is it legal to record sales conversations?

Federal law sets a one-party floor when the recorder is a party. States may be stricter, and in-person rules can differ from phone rules. Open the state chapter. This is not a ruling for a crew.

### How does Knockdesk handle consent, and what does Full desk cost?

Enable Recording asks for Verbal Consent, Written Consent, or Will Record Consent before Start Recording. Full desk is on the pricing page. A free trial is not open.
